                <text>This correspondence to Dr. Lewis Nobles, president of Mississippi College, sent by William H. Leftwich, vice president of the University of Richmond, is in response to E. Bruce Heilman, president of UR, offering Leftwich's legal advice to Nobles after Nobles inquired it via letter from Heilman. Leftwich expressed commiseration to Nobles regarding the Department of Education's Office of Civil Rights (OCR): “It makes one wonder just how far back that office is willing to dig in order to come up with some justification for harassing our educational institutions.” Leftwich wrote that he shared Nobles’ letter from the OCR with his counsel, Eva Tashjian-Brown of McGuire, Woods and Battle, who “did such a superb job for us.” Leftwich offered to provide Nobles with the judgment from UR’s case, in which the university challenged the federal government over compliance with Title IX, and expressed that Tashjian-Brown suggested that Nobles ask for a second opinion from someone higher up (such as the Director of the OCR and/or the Secretary of the Department of Education) regarding the complaint letter from the OCR.</text>

Theberge who was the President of the National Legal Center for the Public Interest in Washington D.C. to the President of the University of Richmond, E. Bruce Heilman. &lt;a href="https://en.wikipedia.org/wiki/AEI_Legal_Center_for_the_Public_Interest" target="_blank"&gt;The NLCPI was founded in 1975 as a conservative think tank whose primary purpose was to lobby against affirmative action programs, and strongly opposed the Americans with Disabilities Act (ADA).&lt;/a&gt; The letter thanks President Heilman for letting President Theberge give a speech to the American Association of Presidents of Independent Colleges and Universities and says that the speech in enclosed. Theberge concludes by asking Heilman to bring to his attention any "government imposed reverse discrimination situations."&lt;p&gt; In accompanying the six page speech, Theberge begins by quoting former Department of Health, Education (HEW) and Welfare Secretary Caspar Weinberger on the real purpose of equal opportunity. In a section entitled "Government Perverts Objective," Theberge outlines his purpose: "There is in our society a broad based consensus which supports the rightness of and the need for equal employment opportunities for all Americans regardless of their color, race, religion or sex. Yet today in attempting to implement a federal program to insure this national goal, various agencies of that government have perverted the original objective, encouraged discriminatory quotas, created confusion and alienated a large segment of the public...I shall review the legislative, administrative and judicial highlights of affirmative action, trace its development, explain what NLCPI is doing and attempt to offer a possible remedy to this problem." &lt;/p&gt;&lt;p&gt;In the following pages, Theberge condemns current federal efforts towards affirmative action, claiming that efforts by the government to uphold the Civil Rights Act of 1964, calling it "an abuse of power by the federal government." He goes on to outline the Bakke case by citing previous cases around racial discrimination, including Brown v. Board and Loving v. Virginia. He outlines the plan of NLCPI as follows: 1. Creating a "positive alternative program" for affirmative action in higher education, 2. Mobilizing conversations on campuses "to encourage open discussion about current abuses," 3. Establishing goals and timetables for lobbying for an alternative program, and 4. Developing a "litigation strategy and capability that will insure that the judicial branch of government receives the best legal briefs that can be prepared."&lt;/p&gt;</text>

                <text>This article indicated that the U.S. Department of Education filed a countersuit against the University of Richmond after UR refused to cooperate with an investigation regarding sex discrimination in its athletics. The countersuit was in response to a suit brought by the University against the Department of Education for overreaching its jurisdiction &amp;ndash; according to the University. William H. Leftwich, vice president for student affairs, indicated that the University&amp;rsquo;s athletic department received no federal funds and therefore the Office for Civil Rights (OCR) had no jurisdiction. Referencing cases in South Carolina and Pennsylvania, Dewey E. Dodds, the regional director of the OCR, indicated that &amp;ldquo;whether the &amp;lsquo;recipient&amp;rsquo; institution receives, directly or indirectly, &amp;lsquo;federal financial assistance&amp;rsquo; [that] benefits its programs and activities&amp;rdquo; is what matters with respect to Title IX. The article cited a &lt;em&gt;Richmond Times-Dispatch&lt;/em&gt; article that reported that Carol Reese, UR&amp;rsquo;s assistance athletic director for women&amp;rsquo;s sports, claimed that UR was not in compliance with Title IX. Furthermore, the article referenced a 1980 edition of &lt;em&gt;The Collegian&lt;/em&gt; that reported on members of the Women&amp;rsquo;s Athletic Council and a 1980 Board of Trustees Report regarding available scholarships.</text>

Smith that the ruling would allow sex discrimination in other programs that “while not directly targeted by federal funds, nonetheless receive and benefit from federal aid.” The article expressed that the National Coalition for Women and Girls in Education also sought an appeal from Secretary Bell.</text>

                <text>This article discusses the decision by the Office of Civil Rights to drop its Title IX investigation of alleged sex discrimination in athletics" at the College of William &amp;amp; Mary. This decision was made because of a prior ruling involving the University of Richmond which determined that because the University of Richmond athletics program does not receive direct federal aid, then that program does not need to adhere by Title IX guidelines. Dale Robinson, William and Mary's director of the Office of Equal Opportunity and Affirmative Action Programs had notified Dewey E. Dodds, Region 3 Director of the Office of Civil Rights, that further communication between Dodds and William and Mary must go through their counsel, assistant attorney general Pamela Sargeant. Sargeant was later contacted and she told Dodds and his office that William and Mary "would not negotiate further on the Title 9 investigation because of the decision of the court in the UR case." Although the case was closed, Dodd mentioned that the college officials indicated that they "may implement several measures which will result in increased athletic opportunities for female intercollegiate athletics."</text>

                <text>This article indicated that the Justice Department’s lack of appeal to the decision banning investigation of sex discrimination in UR’s athletic department “warded off a probe at the College of William and Mary.” Ronald Gilliam, deputy director of the Office of Civil Rights (OCR) in Philadelphia, indicated that it was unknown which complaints of sex discrimination could now be investigated at William and Mary (W&amp;amp;M). The article expressed that U.S. District Judge D. Dortch Warriner expressed that the Justice Department would not appeal the July ruling for UR because “the programs being investigated, not just the students, had to receive federal funds.” William Kramer, Attorney for the National Collegiate Athletic Association (NCAA), expressed that the “Supreme Court’s definition of federal financial aid was insufficient to give federal authorities the legal right to investigate those programs.” The article mentioned W&amp;amp;M's football stadium, which required federal funds to build, and indicated that there would be an eventual decision on whether this would permit an investigation. W&amp;amp;M's affirmative action director, Dale Robinson, expressed surprise at the UR case decision, but indicated that “it will have no effect on W&amp;amp;M’s commitment to equality among men’s and women’s athletic programs."</text>
