                <text>This December 13, 1979 letter is from University of Richmond legal counsel W. Carter Younger to Vice President for Student Affairs William H. Leftwich. In this record, Carter describes a letter received from Dewey E. Dodds, Director of the Office for Civil Rights (OCR) Region III. Carter notes that the transition plan requested by OCR must be completed by January 21, 1980 as based on Adams v. Califano litigation. Carter notes that Dodds's offer of assistance is less demanding than previous interactions with Raymond Hatcher. While Carter is willing to send Dodds and Hatcher a completed transition plan, he expresses concern about entering a negotiating session. Carter attached a "brief affirmative action statement" to his letter. Carter concludes his letter asking for the advice of Leftwich as well as Dean and Professor of Law Tom Edmonds. The attached review is the School of Law Affirmative Action Plan. The plan discusses recruiting and admissions, starting with active recruiting from "colleges which have a high proportion of minority students" including: Virginia State University, Virginia Union University, Hampton Institute, North Carolina Agricultural and Technical, Morehouse College, Morris-Brown College, Spelman College, Clark, and Atlanta University. The plan identifies the utilization of current minority law students as a key part of their recruiting efforts. The plan discusses non-discriminatory placement within the job center, with goals to represent and include minority students. The plan also has a sample of a counseling center visit log, which corresponds to reasons for visit, service codes, and divisions.</text>

                <text>This November 2, 1979 letter is from University of Richmond counsel W. Carter Younger to Director of the Office of Civil Rights (OCR) District III Dewey E. Dodds. The letter is in reference to the compliance review conducted the week of May 7, 1979 by the OCR on the University of Richmond graduate and professional schools. In regards to the OCR letters from September 28, 1979 and October 22, 1979, Younger states that the University is in full agreement with the OCR findings on nondiscrimination. Younger, however, disagrees with the OCR's conclusions regarding other conclusions. Younger critiques the OCR's finding of discrimination based on Reuben S. Alley's, "The History of the University of Richmond, 1830-1971," saying that the book was a product of Alley's opinion, and could not be construed as evidence for discrimination practices. Younger also states that the University disagrees with the statistical basis of the University's minority enrollment, as the University is a private institution with a high tuition rate. Recognizing the University's desire for more minority students, Younger addresses several topic areas identified in Dodds's previous letter. Younger notes that the University will develop a more robust recruitment and admissions program plan, take the OCR's offer to assist with financial aid acquisition, log and monitor counseling services, negotiate non-discrimination assurances from employers using the job placement center, and remodel facilities to provide accessibility.</text>

                <text>This September 22, 1979 letter is from Dewey E. Dodds, Director of the Office for Civil Rights Region III, and is addressed to University of Richmond President Dr. E. Bruce Heilman. Dodds begins the letter by expressing appreciation to University staff for cooperation in the Office for Civil Rights (OCR) compliance review. The review was conducted to determine if the University of Richmond graduate and professional schools were in compliance with Title VI of the Civil Rights act of 1964, Title IX of the Education Amendments of 1972, and Section 504 of the Rehabilitation Act of 1973. The letter then excerpts passages from each of these legal documents. The "review revealed that the University of Richmond previously discriminated against minority applicants" on basis of race, and also had no affirmative action plan designed. As there was still no affirmative action plan, the University was found to not be in compliance with Title VI. Dodds notes that the University's "discriminatory policy is cited in Reuben S. Alley's, "The History of the University of Richmond, 1830-1971," written in collaboration with the University's Board of Trustees. In the History, Alley reported that "blacks were not admitted to the university" prior to 1964. The review established that the University does not specifically target minority applicants, thus reflecting "this lack of affirmative effort." The review found no evidence that the University discriminated on the basis of race, however, the University was not considering race in the application review process. Dodds writes that the University had recruited "significantly lower" graduate and law students, with the University law school having only 4.5 percent minority students, as compared to the Virginia average of 13.3 percent. The review did not find evidence, past or present, of discrimination against women or "the handicapped", however, Dodds lays out specific details for an affirmative action process. These details include targeted recruitment at "traditionally black institutions," and assuring students of financial aid benefits. The review details how counselling and referral services should be available to all students to assure retention rates and track movement through the school toward a degree program. Dodds outlines plans for a more robust job placement center at the law school, as the current center "may not operate in a completely racially unbiased manner." Dodds notes that one student "alleged that a racially restricted job announcement had been posted in the placement center." The review details accessibility protocol, saying that the University's current transition plan was "unacceptable under the regulations." Dodds sets a deadline of June 2, 1980 to complete the transition plan for structural changes. The review found that the University was in compliance with Title IX "except for the lack of a satisfactory self-evaluation and transition plan", and also found that the University was not in compliance and currently in violation of Title VI "with respect to recruitment and admissions." Dodds sets a deadline of  June 2, 1980 to complete directives and achieve compliance with title VI. Dodds directs Heilman to contact the Director of the OCR Postsecondary Education Division, Robert Harvey, for any assistance. William H. Leftwich and R. Moxley are copied on the letter.                 <text>This is the Affirmative Action Plan for The T.C. Williams School Of Law. This document acknowledges the responsibility of the T.C Williams School of Law as a part of the University of Richmond to provide equal opportunity to minority students.This document mentions that equal opportunity will be provided to any graduate or professional studies student and also acknowledges that diversity among the student body is very important to the university. Dr. William Leftwich, Vice President for Student Affairs will be in charge of implementing the plan and overseeing departments to make sure the plan is implemented to its fullest. The equal opportunity policy will be efficiently communicated to faculty and staff by the Dean of the Law School through memos and meetings. The policy will also be published in the bulletins, catalogues, admission documents and other law school communication open to the public. The plan pointed out that the T.C Williams School of Law has been proactively trying to recruit minority students but is being undercut by the high number of law schools nearby and lower tuition rates of those law schools. The law school will actively recruit minority students by making it providing equal opportunity, financial aid and recruiting from undergraduate institutions with a high number of minority students including Virginia Union University, Hampton Institute, Virginia State University and Atlanta University. Also, the placement process for jobs will be practicing the equal opportunity policy along with providing minority students with additional help during this process.&#13;
&lt;p&gt;Though this report is undated, a draft copy available in the papers of President Heilman at the Virginia Baptist Historical Society dates the draft copy to March 24, 1980.&lt;/p&gt;</text>

                <text>This is the Self Evaluation and Transition Plan for The Graduate and Professional Schools at the University of Richmond, likely completed in early 1980. This plan lays out the guidelines for the Graduate and Professional Schools to transition into compliance with &lt;a href="https://en.wikipedia.org/wiki/Rehabilitation_Act_of_1973#Section_504" target="_blank"&gt;Section 504 of the Rehabilitation Act of 1973&lt;/a&gt; which was aimed at eliminating discrimination of people with disabilities from programs and institutions receiving federal funding. This document evaluates the situation regarding accessibility to disabled individuals at the university. The committee for the this evaluation was chaired by Dr. William Leftwich, Vice President for Student Affairs. There were other members from the university involved in this evaluation. This included Dr. D. Robert Moxley, William Rhodes, Ronald Hicks, Dr. William Woolcott (noted as a disabled individual in the report), Walter Van Klein, Mary Thoephanos (noted as a student who uses a wheelchair in the report), Michael Decker, and Eva S. Tashjian-Brown. After the evaluation a plan was drafted for the transition and the plan was to be fully implemented by June, 1980. Dr. Leftwich was mainly in charge of enforcing the plan and overseeing the execution of the plan from different departments and programs. Physical and structural changes were to be made to almost every building on campus to make it more accessible. In addition, redesigning equipment, reassigning classes to accessible buildings, providing aid to students with disabilities and rescheduling classes/activities was being considered as alternatives. The recruitment and admissions process would be made more accessible and a statement of non-discrimination would be included in every step of the admissions process. Changes would be made to make sure that disabled individuals can excel academically with policies which would provide longer attending periods for qualified individuals with disabilities. Campus facilities like Financial Assistance, Physical Education and Athletics, Counseling and Placement services and Social Organizations will be enforcing a non-discrimination policy and have equal opportunity for disabled individuals. The Committee suggested that a more specific contingency plan be designed for specific situations and the faculty and staff be reminded of the new law to prevent discrimination. The document expresses the promise of compliance to the legislation several times for reassurance.</text>

                <text>This is a letter from William Flynn and James Frank, President and Secretary-Treasurer of the National Collegiate Athletic Association (NCAA) respectively, towards the  Chief Executive Officers, Faculty Representatives and Directors of Athletics of NCAA Member Institutions. The writers inform that the Office for Civil RIghts of the Department of Health, Education and Welfare (HEW) is investigating institutions for which the office has received complaints of Title IX violation. Accordingly, University of Akron, University of Bridgeport, Cornell University, Howard University, University of Kansas, University of Michigan, Oklahoma State University and Washington State University were eight among the 80 institutions that have complaints pending, a statistic that did not include those colleges and universities against which complaints had recently been filed. Moreover, the memo states the process that the institutions must undertake if they are subject to a Title IX compliance review by the Office of Civil Rights. This process involves a data request by the office, which shall be responded to and analyzed  by the office, followed with on-site investigations and interviews at the college or university and post-on-site analysis of data collected. Based on these allegations, the office determined that they had the authority to investigate the issue, which appeared to fall under Title IX of the Education Amendments of 1972. According to the letter, this amendment "prohibits sex discrimination in educational programs or activities receiving Federal financial assistance." Moreover, Dodds refers President Heilman to Robert E. Harvey, Director of Postsecondary Education Division at the office for future reference if the former has any questions.</text>

Carter Younger responds to Dewey Dodds, Director of Department of Education’s Office of Civil Rights, regarding the previous correspondence sent to President E. Bruce Heilman. In the latter, Dodds informs the president that there will be an investigation to verify University of Richmond’s compliance to Title IX as a result of a complaint alleging discrimination against sex in athletics. Younger, appointed as legal counsel for the university, replies to Dodds requesting a copy of the complaint in order to “determine the jurisdictional basis for any investigation and have sufficient information to respond appropriately.” Moreover, the counsel stated that the university has the right to not be “harassed or intimidated with the threat of a time consuming and costly investigation based on undisclosed charges by an unidentified person.” Younger mentions there have been three other occasions in a period of two years in which UR had to host inspectors from the Office of Civil Rights, which he claims diverts time and funds from the education of students. One of the team members that led the visitation in 1979 was Cynthia G. Brown, who was principal deputy. Lastly, the counsel concludes the letter by stating that the “investigations are time consuming and particularly burdensome during the spring months”, and because the university is a private institution the costs involved in proceeding with the investigation would have to be added to the “already high tuition”, and therefore, the university objects to follow the demand.</text>

Bruce Heilman by Dewey Dodds, Director of Department of Education’s Office of Civil Rights, regarding the compliance review of Title IX of the Education Amendments of 1972. Dewey reiterates that this regulation “prohibits sex discrimination in federally assisted education programs and activities” and that a complaint was filed with the office on January 22, 1981 alleging that the University of Richmond was discriminating against sex in its intercollegiate athletic program. Therefore, Dodds informs Heilman that it is part of the responsibility of the Department of Education to conduct a compliance review, hence he requests the provision of certain data prior to their visit in order to “minimize the amount of time that you and your staff need to devote to this review.” Among other things, the data requested includes: copies of the 1979-1980 budgets for men’s and women’s intercollegiate athletic programs; copies of written policies for awarding athletic financial assistance to male and female athletes, establishing competitive and practice schedule, and determining the use and availability of facilities; a list of methods of transportation used by each team, as well as a list of each training and conditioning facility available to athletes by sex and their location on campus, etc.</text>
