<text>This article discusses the Title IX law passed by Congress in 1975, which grants women equal opportunity for scholarship as men. Westhampton College was at least 2 years behind major competitors at meeting the specifications of Title IX by 1978. The assistant athletic director, Carol Reese, argues that there has been progress since the University now provides practice uniforms and shoes to in women's sports, but not a single woman on a varsity team had a scholarship. Additionally, with the integration of Title IX, women’s sports will now be broken down to divisional classifications just like men. Carol Reese claims that Westhampton College is behind other schools due to the lack of funding: “It takes money to build up a competitive program."</text>

<text>This article is a critique of the Reagan administration regarding two cases where the author believes the president is allowing discrimination. The first case is regarding Bob Jones University in South Carolina and Goldsboro Christian Schools in North Carolina. Both universities are taking steps so that the Supreme Court eliminates the Internal Revenue Service policy. The latter prohibits tax exemptions for institutions that discriminate. Since according to the article, both institutions discriminate against black people, they are faced with the obligation of paying Social Security and federal employment taxes, which are normally relieved by the tax exemptions. The Reagan Administration has taken the school&rsquo;s side in the issue arguing that &ldquo;the administration does not have the authority to enforce the rule,&rdquo; and that &ldquo;the tax code should not be used to enforce civil-rights laws.&rdquo; The other case touched upon in the article is that of the University of Richmond, in which the Department of Education has reached out to the institution in order to investigate a complaint regarding sex discrimination in athletics. The writer informs that this institution was: &ldquo;pouring millions into sports program for men, but almost nothing into sports programs for women.&rdquo; The university filed a suit against the Education Department in a lower court and according to the author, it has not denied the inequities but argued that &ldquo;because the federal government did not directly fund the athletic department, the law did not apply.&rdquo; In this case, the government did not want to appeal, which caused the head of the U.S. Civil Rights Commission, Clarence Pendleton Jr. to write a dissent arguing that the Justice Department&rsquo;s policy could &ldquo;reduce the civil-rights protections significantly.&rdquo;</text>

<text>In this letter, the Women’s Athletic Council at the University of Richmond addresses the Director of the U.S. Department of Education’s Office for Civil Rights. The council is filing a complaint against the University of Richmond, given that the institution was “discriminating against women athletes and the coaches of women’s sports, as well as discriminating against women in other areas of University activities.” The council establishes that such behavior violates Title IX of the Education Amendments of 1972. The writer alleges that those affecting women’s athletics include: Mr. Charles Boone, Athletic Director, Dr. William Leftwich, Title IX Coordinator, Dr. E. Bruce Heilman, President of the University, and the Board of Trustees. The council requests an investigation of the complaints and attaches the Board of Trustees’ report on level of Competition for Non-Revenue Sports, in which the writer questions the exclusion of budget figures on men’s basketball and football.</text>

<text>This article which appeared in the Wall Street Journal on April 12, 1979 discusses how the law has changed to forbid "sex discrimination in educational institutions that get federal funds." It brings up that the Department of Health, Education, and Welfare (HEW) has introduced policy that would require schools receiving federal funding to provide proportional funding equal to the number of people participating in athletics. The author writes that, "In other words, it is going to demand 'substantially equal per capita expenditures' - on athletic scholarships, recruitment, equipment and supplies, travel and publicity." The author continues to make an argument that this policy leaves many schools with few options and that "if schools cut too much, they risk hurting their teams' competitiveness and therefore their revenue potential." They write that because women's' participation in college athletics has more than doubled and women make up 26% of the country's intercollegiate athletes, then there is no need for such "drastic measures." Finally, the author ends the article with a claim that there is "something deeper at work here: a drive to see all American institutions governed by the same system of rewards.." They call for HEW to consider different factors before issuing its final guidelines and asks for Congress to do so if HEW does not. This article was sent to University of Richmond President E. Bruce Heilman by Virginia Congressman David E. Satterfield III attached to a letter on April 16, 1979.</text>

<text>This article indicated that the Justice Department’s lack of appeal to the decision banning investigation of sex discrimination in UR’s athletic department “warded off a probe at the College of William and Mary.” Ronald Gilliam, deputy director of the Office of Civil Rights (OCR) in Philadelphia, indicated that it was unknown which complaints of sex discrimination could now be investigated at William and Mary (W&amp;M). The article expressed that U.S. District Judge D. Dortch Warriner expressed that the Justice Department would not appeal the July ruling for UR because “the programs being investigated, not just the students, had to receive federal funds.” William Kramer, Attorney for the National Collegiate Athletic Association (NCAA), expressed that the “Supreme Court’s definition of federal financial aid was insufficient to give federal authorities the legal right to investigate those programs.” The article mentioned W&amp;M's football stadium, which required federal funds to build, and indicated that there would be an eventual decision on whether this would permit an investigation. W&amp;M's affirmative action director, Dale Robinson, expressed surprise at the UR case decision, but indicated that “it will have no effect on W&amp;M’s commitment to equality among men’s and women’s athletic programs."</text>

<text>In this letter, W. Carter Younger responds to Dewey Dodds, Director of Department of Education’s Office of Civil Rights, regarding the previous correspondence sent to President E. Bruce Heilman. In the latter, Dodds informs the president that there will be an investigation to verify University of Richmond’s compliance to Title IX as a result of a complaint alleging discrimination against sex in athletics. Younger, appointed as legal counsel for the university, replies to Dodds requesting a copy of the complaint in order to “determine the jurisdictional basis for any investigation and have sufficient information to respond appropriately.” Moreover, the counsel stated that the university has the right to not be “harassed or intimidated with the threat of a time consuming and costly investigation based on undisclosed charges by an unidentified person.” Younger mentions there have been three other occasions in a period of two years in which UR had to host inspectors from the Office of Civil Rights, which he claims diverts time and funds from the education of students. One of the team members that led the visitation in 1979 was Cynthia G. Brown, who was principal deputy. Lastly, the counsel concludes the letter by stating that the “investigations are time consuming and particularly burdensome during the spring months”, and because the university is a private institution the costs involved in proceeding with the investigation would have to be added to the “already high tuition”, and therefore, the university objects to follow the demand.</text>

The countersuit was in response to a suit brought by the University against the Department of Education for overreaching its jurisdiction &ndash; according to the University. William H. Leftwich, vice president for student affairs, indicated that the University&rsquo;s athletic department received no federal funds and therefore the Office for Civil Rights (OCR) had no jurisdiction. Referencing cases in South Carolina and Pennsylvania, Dewey E. Dodds, the regional director of the OCR, indicated that &ldquo;whether the &lsquo;recipient&rsquo; institution receives, directly or indirectly, &lsquo;federal financial assistance&rsquo; [that] benefits its programs and activities&rdquo; is what matters with respect to Title IX. The article cited a <em>Richmond Times-Dispatch</em> article that reported that Carol Reese, UR&rsquo;s assistance athletic director for women&rsquo;s sports, claimed that UR was not in compliance with Title IX. Furthermore, the article referenced a 1980 edition of <em>The Collegian</em> that reported on members of the Women&rsquo;s Athletic Council and a 1980 Board of Trustees Report regarding available scholarships.</text>

The writer informs that the university filed a suit in Federal District Court by University counsel against the Department of Education's' Office for Civil Rights (OCR) at 4:00 pm on April 23. Leftwich communicates that the timing was strategically selected given that it was "one day prior to the day we had been asked by the Office of Civil Rights to submit documentation to them." This documentation was concerning a data request by the OCR in order to investigate a sex discrimination complaint against the University in its athletic program. Leftwich says that the university's legal counsel, W. Carter Younger, established that the suit is a matter of public record.</text>

Rice, and Ms. Carol Reese explaining how the Department of Health, Education and Welfare (HEW) has recently provided a new set of Title IX regulations about women's athletics. Because of these new regulations, the University has a need to "update its existing plan to insure consistency with these new regulations." Leftwich, along with Chuck Boone and with the approval of University president E. Bruce Heilman, asks the recipients if they would like to serve on an "ad hoc committee" in order to update the University plan. He adds that this "Committee on Women's Athletics and Title IX" will begin soon and will be complete within several months.</text>
