Severinson lists a number of suggestions that would aid in getting the University to comply with the Civil Rights Act of 1964. The article goes on to discuss how HEW has reached out to Governor Linwood Holton to draft a statewide college desegregation plan by the end of November, but one that won't affect private institutions. Carter Younger to Raymond Hatcher of the U. S. Office of Civil Rights, Department of Health, Education and Welfare (HEW). The letter describes the plans of the graduate school and law school to increase minority enrollment in several different ways. Younger notes Dewey E. Dodds's letter dated September 28, 1979, which cleared the University of Richmond from a claim that it currently had discriminatory policies. Younger acknowledges that "the alleged policy against admitting blacks was abolished in 1964." Younger writes that Dodds' letter stated that affirmative action was necessary to overcome "the alleged effects of such pre Civil Rights Act policy." Younger contests the idea that the University "underutilized" minority students. Younger justifies the low minority enrollment rate at T. C. Williams School of Law by noting that private institutions are significantly more expensive than state law schools, making it improper to compare state school statistics to private school statistics. Younger offers an alternative viewpoint, cross referencing data from similarly sized private institutions to show that the University has a higher minority enrollment rate compared to similar institutions. Younger argues that Dodds' use of statistics are not taking into account the context of the University and the competitive nature of institutions of higher learning in the greater Richmond area. Younger notes that the committee for self-evaluation will meet on January 7, 1980. The Graduate School affirmative action plan begins with an assessment on why the University has lower numbers of minority students, primarily because of the presence of less expensive state schools. To combat these low numbers, the University plans to encourage applications from undergraduate schools with high proportion of minority students. The plan also reviews financial aid, recruiting "disadvantaged full-time students", and implementing non-discriminatory practices. The plan also reviews job placement, with a non-discrimination policy when connecting students to future employers. The second review is the School of Law Affirmative Action Plan. The plan discusses recruiting and admissions, starting with active recruiting from "colleges which have a high proportion of minority students" including: Virginia State University, Virginia Union University, Hampton Institute, North Carolina Agricultural and Technical, Morehouse College, Morris-Brown College, Spelman College, Clark, and Atlanta University. The plan identifies the utilization of current minority law students as a key part of their recruiting efforts. The plan discusses non-discriminatory placement within the job center, with goals to represent and include minority students. Dodds, Director of the Office for Civil Rights Region III, and is addressed to University of Richmond President Dr. E. Bruce Heilman. Dodds begins the letter by expressing appreciation to University staff for cooperation in the Office for Civil Rights (OCR) compliance review. The review was conducted to determine if the University of Richmond graduate and professional schools were in compliance with Title VI of the Civil Rights act of 1964, Title IX of the Education Amendments of 1972, and Section 504 of the Rehabilitation Act of 1973. The letter then excerpts passages from each of these legal documents. The "review revealed that the University of Richmond previously discriminated against minority applicants" on basis of race, and also had no affirmative action plan designed. As there was still no affirmative action plan, the University was found to not be in compliance with Title VI. Dodds notes that the University's "discriminatory policy is cited in Reuben S. Alley's, "The History of the University of Richmond, 1830-1971," written in collaboration with the University's Board of Trustees. In the History, Alley reported that "blacks were not admitted to the university" prior to 1964. The review established that the University does not specifically target minority applicants, thus reflecting "this lack of affirmative effort." The review found no evidence that the University discriminated on the basis of race, however, the University was not considering race in the application review process. Dodds writes that the University had recruited "significantly lower" graduate and law students, with the University law school having only 4.5 percent minority students, as compared to the Virginia average of 13.3 percent. The review did not find evidence, past or present, of discrimination against women or "the handicapped", however, Dodds lays out specific details for an affirmative action process. These details include targeted recruitment at "traditionally black institutions," and assuring students of financial aid benefits. The review details how counselling and referral services should be available to all students to assure retention rates and track movement through the school toward a degree program. Dodds outlines plans for a more robust job placement center at the law school, as the current center "may not operate in a completely racially unbiased manner." Dodds notes that one student "alleged that a racially restricted job announcement had been posted in the placement center." The review details accessibility protocol, saying that the University's current transition plan was "unacceptable under the regulations." Dodds sets a deadline of June 2, 1980 to complete the transition plan for structural changes. The review found that the University was in compliance with Title IX "except for the lack of a satisfactory self-evaluation and transition plan", and also found that the University was not in compliance and currently in violation of Title VI "with respect to recruitment and admissions." Stanley Pottinger, Director of the Office for Civil Rights of the U.S.Department of Health, Education and Welfare (HEW) to Ernest L. Wilkinson, President of Brigham Young University (BYU) in Provo, Utah. The original letter, dated March 5, 1971, informs President Wilkinson that BYU's policy of "giving preference to Mormons for faculty and administrative positions" did not constitute religious discrimination to the Office of Federal Contract Compliance, and determined that "affiliation with the Mormon Church is a bona fide occupational qualification for faculty members and administrators" reasons including the foundation of BYU as a University "to provide education a a religious setting which permeates the entire life of the school," that faculty members are sometimes recruited from other colleges to teach courses in Mormon theology, that faculty and administrators are tasked with serving as leaders in wards and states at BYU, that students requesting counsel from faculty and administrators should receive counsel that aligns with BYU's "desires that such advice be consistent with the Church's principles," that teaching needs to be done by those familiar with Mormon principles, and that the university encourages participation with the Mormon Church from faculty and administrators. Pottinger concludes by noting that even though this preference has not been labeled as discrimination, any discrimination "with regard to race, color, sex, or national origin" would prompt "affirmative action" from the federal government.<p>This letter was shared with University of Richmond President E. Seaborg of the United States Atomic Energy Commission (AEC) stated that the AEC issued a new regulation which prohibited discrimination in any program or activity receiving financial assistance from the AEC. It was implemented Title VI of the Civil Rights Act of 1964 , which directed every Federal agency having the power to grant financial assistance to issue regulations to ensure this portion of the Civil Rights Act was effectively carried out. The new addition to the AEC’s regulations, Title 10, Code of Regulations, Part 4, stated that there would be “Nondiscrimination in Federally Assisted Commission Programs.” This regulation applied to money paid, property transferred, or other AEC financial assistance. It applied to assistance before and after the effective date, as well as assistance such as AEC-authorized grants, loans, or contracts where the terms required compliance with the regulation. This regulation had been approved by the President. The assurance did not apply to assistance of insurance or guarantee contracts. This assurance was binding on the University, its successors, transferees, signees, and the person whose signatures appear on the signature portion of the letter. Haworth addressed Presidents of Colleges and Universities, Presidents of Professional Societies and Academies of Science, Heads of Institutes and other non-profit organizations. This letter was mailed to President Modlin. In this letter, Haworth discussed President Lyndon B. Johnson’s signing of the Civil Rights Act of 1964 into law on July 2, 1964. Title VI of the Act states that “No person in the United States shall, on the ground of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal funding assistance” (Section 601). He then discussed Section 602 which calls for rules and regulations to carry out this new Act. Haworth goes on, saying that when the Foundation’s regulations are issued, grants and contracts are subject to review, under the new regulations, whether grantees or contractors are meeting the new requirements and are eligible to continue receiving federal assistance. He suggests that institutions may review their policies and practices to ensure they can provide assurance with the compliance of the new regulations. Haworth ends the letter by saying that he believes educational and research institutions will exercise leadership effectively in this step toward equal opportunity under the law, and that the Foundation is ready to discuss the application of the new regulations to programs of the Foundation with any institution. Modlin to Dr. Eloise Severinson, regional civil rights director from the Department of Health, Education and Welfare (HEW), is responding to a recent article from <em>The Richmond Times-Dispatch</em>, which discussed a letter that was sent from Dr. Severinson to Modlin. Modlin writes that he assumes that the letter was disclosed from Dr. Severinson&rsquo;s office, as it &ldquo;has not left [his] office.&rdquo; Modlin goes on to say that it is unfortunate that the letter was released, as he hasn&rsquo;t been able to meet with his Board of Trustees to discuss Severinson&rsquo;s suggestions, and writes that &ldquo;such publicity makes more difficult our efforts to carry out your recommendations, especially those requiring the good will of black students, black faculty members, and predominantly black institutions.&rdquo; Modlin writes that he hopes that HEW does not think that publicity will help accomplish the goals of their organization, and writes that he would like some assurance of good faith from their organization moving forward. Modlin from Dr. Eloise Severinson, the Regional Civil Rights Director of the Department of Health, Education and Welfare (HEW), in regards to whether the University of Richmond was in compliance with the Civil Rights Act of 1964. Through investigation, HEW felt as though the university could use some suggestions as to how to further implement the equality that the Civil Rights Act of 1964 calls for. Dr. Severinson then lists her recommendations, among which include publicizing to the black community in Richmond and the state of Virginia that they have an equal education opportunity policy, attempting to recruit black athletes, and encouraging college campus visits from black high school students. Dr. Severinson then goes on to write that HEW “[expects] to make a routine contact with the University of Richmond in approximately one year” and request to see records of predominantly black high schools contacted by the University, records of black student groups invited to tour the University, and records that black athletes were contacted and interviewed.
