Pendleton, Jr., warned that enforcement of Title IX could be “severely undermined if the government does not appeal a ruling by a federal district court judge in Richmond, Va.” Pendleton, Jr. (appointed by President Reagan) expressed to the Departments of Justice and Education that if the decision stood, it would “’decimate civil rights protections in education and undermine the broad remedial purpose of Title IX of the Education Amendments of 1972.” Referencing Judge D. Dortch Warriner’s July decision in the U.S. District Court for the Eastern District of Virginia, the article indicated that the Justice Department was uncertain whether it would appeal. Pendleton wrote to Education Secretary Terrel H. Bell and Attorney General William F. Smith that the ruling would allow sex discrimination in other programs that “while not directly targeted by federal funds, nonetheless receive and benefit from federal aid.” The article expressed that the National Coalition for Women and Girls in Education also sought an appeal from Secretary Bell.</text>

                <text>This article indicated that the U.S. Department of Education filed a countersuit against the University of Richmond after UR refused to cooperate with an investigation regarding sex discrimination in its athletics. The countersuit was in response to a suit brought by the University against the Department of Education for overreaching its jurisdiction &amp;ndash; according to the University. William H. Leftwich, vice president for student affairs, indicated that the University&amp;rsquo;s athletic department received no federal funds and therefore the Office for Civil Rights (OCR) had no jurisdiction. Referencing cases in South Carolina and Pennsylvania, Dewey E. Dodds, the regional director of the OCR, indicated that &amp;ldquo;whether the &amp;lsquo;recipient&amp;rsquo; institution receives, directly or indirectly, &amp;lsquo;federal financial assistance&amp;rsquo; [that] benefits its programs and activities&amp;rdquo; is what matters with respect to Title IX. The article cited a &lt;em&gt;Richmond Times-Dispatch&lt;/em&gt; article that reported that Carol Reese, UR&amp;rsquo;s assistance athletic director for women&amp;rsquo;s sports, claimed that UR was not in compliance with Title IX. Furthermore, the article referenced a 1980 edition of &lt;em&gt;The Collegian&lt;/em&gt; that reported on members of the Women&amp;rsquo;s Athletic Council and a 1980 Board of Trustees Report regarding available scholarships.</text>

                <text>This October 15, 1980 compliance review is from University counsel Eva S. Tashjian-Brown for Dewey E. Dodds, Director of the Office for Civil Rights (OCR) Region III. The review is in response to Dodds' September 30, 1980 letter to E. Bruce Heilman, President of the University of Richmond. Tashjian-Brown reminds Dodds and his staff to direct all communications regarding the compliance review to the counsel for the University, to protect the University's right to counsel. Tashjian-Brown refers to University counsel Carter Younger's March 31, 1980 letter to Lee Nell which detailed the Affirmative Action Plan of the T. C. Williams School of Law, the Graduate Student Division, and the Self-Evaluation and Transition Plan of the Graduate and Professional Schools. Tashjian-Brown notes that the University must "respectfully disagree" to Dodds's letter which indicated "commitments beyond those specifically stated in the above documents." The compliance review begins with Recruitment of Minority Students. It is stated that the Law School participated again with the CLEO Program, a pre-law program, and that a second year student was paid by the University to serve as a teaching assistant and recruit candidates for the Law School. University administrators and faculty recruited from several historically black colleges and universities, including Virginia State University, Virginia Union University, Hampton Institute, North Carolina Agricultural and Technical, Atlanta University Center, Howard University Graduate &amp;amp; Professional School Fair, Johnson C. Smith University, among others. The Law School also planned to develop an admissions by performance program in the summer of 1981. The University requests the assistance of OCR to secure additional financial aid. Law School officials also began to establish the Oliver Hill Scholarship program. The review states that all application forms and university publications have a non-discrimination statement. The University also plans to develop assurances of non-discriminatory employers for the job placement service offered by the university. The plan addresses specific accommodations "for the handicapped" including parking spaces, ramps and curb cuttings, new Braille indicators, telephone lowering, and a new wing on the Law School with accessibility features. The University plan also features a centralized system for accommodating "the handicapped". This letter is blind carbon copied to Dr. Bruce Heilman, Dr. William Leftwich, and W. In the latter, Dodds informs the president that there will be an investigation to verify University of Richmond’s compliance to Title IX as a result of a complaint alleging discrimination against sex in athletics. Based on these allegations, the office determined that they had the authority to investigate the issue, which appeared to fall under Title IX of the Education Amendments of 1972. According to the letter, this amendment "prohibits sex discrimination in educational programs or activities receiving Federal financial assistance." Bruce Heilman by Dewey Dodds, Director of Department of Education’s Office of Civil Rights, regarding the compliance review of Title IX of the Education Amendments of 1972. Dewey reiterates that this regulation “prohibits sex discrimination in federally assisted education programs and activities” and that a complaint was filed with the office on January 22, 1981 alleging that the University of Richmond was discriminating against sex in its intercollegiate athletic program. Therefore, Dodds informs Heilman that it is part of the responsibility of the Department of Education to conduct a compliance review, hence he requests the provision of certain data prior to their visit in order to “minimize the amount of time that you and your staff need to devote to this review.” Among other things, the data requested includes: copies of the 1979-1980 budgets for men’s and women’s intercollegiate athletic programs; copies of written policies for awarding athletic financial assistance to male and female athletes, establishing competitive and practice schedule, and determining the use and availability of facilities; a list of methods of transportation used by each team, as well as a list of each training and conditioning facility available to athletes by sex and their location on campus, etc.</text>
