Bruce Heilman with concerns that there are few minority students enrolled at the University of Richmond. The students lined out actions that they felt the administration needed to take in order to fix this deficiency. They outlined that there needs to be a commitment to diversified student body needs, a minority recruiter employed by the admissions office, a catalogue that shows commitment to a diversified student body, minority students as recruiters, and participate in a model cities program for underprivileged students in order to reach black high school students.The organization, Students for a Well-Balanced Campus, noted that the letter originated from their organization which was founded under the YWCA in the fall of 1970 and at the time was under the auspices of the USGA. Stanley Pottinger, Director of the Office for Civil Rights of the U.S.Department of Health, Education and Welfare (HEW) to Ernest L. Wilkinson, President of Brigham Young University (BYU) in Provo, Utah. The original letter, dated March 5, 1971, informs President Wilkinson that BYU's policy of "giving preference to Mormons for faculty and administrative positions" did not constitute religious discrimination to the Office of Federal Contract Compliance, and determined that "affiliation with the Mormon Church is a bona fide occupational qualification for faculty members and administrators" reasons including the foundation of BYU as a University "to provide education a a religious setting which permeates the entire life of the school," that faculty members are sometimes recruited from other colleges to teach courses in Mormon theology, that faculty and administrators are tasked with serving as leaders in wards and states at BYU, that students requesting counsel from faculty and administrators should receive counsel that aligns with BYU's "desires that such advice be consistent with the Church's principles," that teaching needs to be done by those familiar with Mormon principles, and that the university encourages participation with the Mormon Church from faculty and administrators. Pottinger concludes by noting that even though this preference has not been labeled as discrimination, any discrimination "with regard to race, color, sex, or national origin" would prompt "affirmative action" from the federal government.This letter was shared with University of Richmond President E. Bruce Heilman by Assistant to the President & Director of Estate Planning Charles W. Patterson, III on July 4, 1973, it was given to Patterson by Asbner McCall. Heilman shared it with James L. At the time, the graduate school had programs for Master of Arts, Master of Science, Master of Education, and Master of Humanities degrees. One of the problems that UR experiences in recruiting minority students for its graduate program is that there is another private school in Richmond (Virginia Union University), and two state supported institutions, (Virginia Commonwealth University and Virginia State University) and they compete with UR. For VSU it costs $1,000 per year and at VCU it cost $790 whereas UR's is $3,510. Part-time students would also have to pay 36% more for a single course than VCU students did. Action oriented programs would include UR encouraging applications from students at undergraduate schools that have a high minority proportion. All the recruiting materials will also include UR's policy of encouraging minority participation. The Graduate School application will have the following statement: "Admission to the University of Richmond is without regard to race, color, sex, age, religion, national origin or physical handicap." Admission decisions will be based on grades and test scores, but also on other factors such as a student's background which might demonstrate potential success. Because there is a difference in cost at UR than at other schools UR will make efforts with financial aid to recruit disadvantaged full-time students. The financial aid will be awarded without regard to race, color, sex, age, religion, national origin or physical handicap. To insure that minority students have full access to placement services UR will take steps so that each employer seeking to recruit on campus will receive the following statement: "The University of Richmond Career Planning and Placement Office is committed to a policy against discriminatory practices based upon sex, age, race, color, religious creed, national origin or physical handicap in interviewing and employment of our students and alumni." Placement personnel are also directed to investigate any complaints by students alleging discriminatory practices by employers in interviewing and recruiting students.Though this report is undated, a draft copy available in the papers of President Heilman at the Virginia Baptist Historical Society dates the draft copy to March 24, 1980. Hubbell of Ypsilanti, Michigan had contacted President E. Bruce Heilman about. The policy was studied by the Board of Trustees and a new policy was approved stating that all divisions of UR will consider applicants who meet the academic requirements without regard to race, color, or national origin. The University has made efforts to comply with the Civil Rights Act of 1964. The letter states "The University of Richmond has had minority students other than Negroes, on its rolls for many years; and since 1966 it has welcomed an increasing number of full-time and part-time Negro students." Heilman stated that UR conducted vigorous recruiting programs for all students, including minority students as well as increased efforts to use scholarship and federal funds to attract low-income students and qualified minority students. Despite all of these efforts UR was experiencing difficulty recruiting black students. The reply from Heilman was blind copied to Dean C.J. Gray and Mr. John A. Williams School of Law and for the Graduate Students Division at the University of Richmond. It was sent by W. Carter Younger, legal counsel from McGuire, Woods & Battle to Lee Nell, Esquire at the Office of Regional Counsel at the Department of Health, Education & Welfare (HEW) on March 31, 1980. The following was discussed in a March 25th meeting. For the graduate school, contacts of schools with a high proportion of minority students will include communication of the University interested in obtaining applications from qualified students. Encouragement to minority students to refer other potential applications to the graduate school would be implemented. The availability of financial aid and the procedures for receiving it will be communicated so that applicants have access to information before the application deadline. For the T.C. The memo discussed the newly developed format for development of an affirmative action plan by institutions of higher education. There are five race/ethnic categories which will be used for statistical reporting and suggests methods for collecting and presenting data. The five basic categories are "American Indian or Alaskan Native," "Asian or Pacific Islander," "Black/Negro," "Caucasian/White," "Hispanic." There are alternative methods of collecting data for racial and ethnic information such as asking one question with mutually exclusive racial and ethnic categories or asking two questions, one racial and one background. He said that the admission applications for the 1968-69 session lacked efforts for recruiting black students. Modlin listed efforts that UR would take to increase black enrollment such as advertisements of courses in the Richmond Afro-American, a local black newspaper; meeting with high school counselors of Richmond City schools to discuss the programs for recruiting black students; recruiting student athletes without regard to race and UR coaches visiting predominantly black schools. At the time this letter was written black students were enrolled in six of the seven divisions of the university.
